Terms and Conditions

1. Definitions

We / Us / Our: Alex Owen Brown Interiors.

Customer / You / Your: The person(s) named on the invoice.

Order: The item(s) detailed in the deposit invoice.

Deposit: The initial 60% payment based on the estimate total.

Balance: The remaining 40% of the estimate, plus any additional costs or services not included in the final estimate.​

2. General

These Terms and Conditions apply to all products and services supplied by Alex Owen Brown Interiors. By making a deposit payment, you agree to these Terms and Conditions.

3. Estimates

  • Validity: Estimates are valid for 30 days from the date of issue.

  • Acceptance: Acceptance must be made in writing via email.

  • Changes: After 30 days, prices may change, and a new estimate will be required.

4. Payment Structure and Order Process

  • Deposit Payment: A 60% non-refundable deposit will be invoiced upon acceptance of the estimate. Payment of the deposit implies full agreement to these Terms and Conditions.

  • Customer Responsibility: You are responsible for checking the order details carefully before making a deposit payment.

  • Changes to Orders: Changes must be requested promptly and cannot be guaranteed after the deposit has been paid.Any adjustments to price or lead time will be confirmed before proceeding.

  • Additional Items: Additional items requested after deposit payment will be treated as a separate order.

  • Additional Services: Services added after the deposit has been paid, such as instillation, delivery, hanging, and steaming not included in the final estimate, will be added to the balance invoice.

  • Balance Invoice: The balance of 40% plus any additional charges is due upon receipt of the invoice.

  • Payment Methods: Payments must be made by bank transfer in GBP (£) or by card via QuickBooks. No other forms of payment are accepted.

  • Ownership: All goods remain the property of Alex Owen Brown Interiors until full payment is received.

  • Late Payment: Invoices are payable in full upon receipt. We reserve the right to charge  interest at 4% above the Bank of England base rate per month, calculated daily from the due date until full payment is received.

5. Cancellations, Returns, and Delays

  • Made-to-Measure Products: Cannot be cancelled or returned once production has begun. Cancellation rights do not apply to custom-made goods under the Consumer Contracts Regulations 2013.

  • Deposit Non-Refundable: Deposits are non-refundable in all circumstances, including customer cancellation prior to production.

  • Service Cancellation: Cancellation of services (consultation, measuring, or installation) after appointment booking may incur a fee depending on the service booked.

  • Incorrect Items: We will correct or replace incorrect made-to-measure items.

  • Client-Supplied Measurements: We are not responsible for inaccuracies in client-supplied measurements.

  • Delays: We are not liable for supplier delays or events outside our control, including damaged fabric, acts of God, strikes, transport delays, or public emergencies. Delivery dates are estimates and cannot be guaranteed.

  • Order Cancellation by Us: In exceptional cases where we must cancel your order, a full refund of your deposit will be given within 5 working days. No additional compensation will be provided.

6. Fabric Supplied by Alex Owen Brown Interiors

  • Sampling: We strongly recommend ordering fabric samples or a one-metre cut for larger patterns prior to confirming your order. We do not offer replacements or refunds for items made using fabrics that closely match samples, or if the overall appearance differs from expectations on a larger scale.

  • Colour Variations: Minor batch-to-batch colour variations are normal. Fabric for a project will be ordered from the same batch, but later orders may not match perfectly.

  • Faulty Fabrics: All fabrics are carefully inspected prior to cutting. If a fault is identified, we will liaise with the supplier to arrange a replacement. We are not responsible for any resulting delay or disruption to the project timeline.

  • Fire-Retardant (FR) Fabrics: Standard Supply: Curtains and soft furnishings are made from non-FR fabrics by default. FR-treated fabrics will only be supplied if specifically requested by the customer at the time of order;  It is the customer’s responsibility to specify the requirement for FR fabrics for domestic projects.

  • Commercial Requirements: In commercial settings where FR fabrics are legally required (e.g., hotels, restaurants, public buildings), FR compliance will be provided in accordance with UK fire safety regulations.

  • Lead Times and Costs: FR fabrics may incur additional cost and slightly longer lead times.

 

7. Fabric Supplied by the Customer

  • Fabric Condition: We are not responsible for the quality, suitability, or condition of customer-supplied fabric. Inspect thoroughly before supplying.

  • Ordering and Delivery: The customer must source and deliver fabric directly. We do collect fabric, place orders or receive deliveries on your behalf.

  • Fabric Requirements: Customers must ensure the quantity and quality of fabric meets project requirements.

  • Suitability & Performance: We cannot guarantee the outcome or performance of items made with customer-supplied fabric. Any advice offered is given in good faith.

  • Customer-Supplied Fabric Charges: A cutting fee of £14.50 + VAT per metre can be charged on customer-supplied fabric.

 

8. Curtain Poles and Tracks

  • Measurements: All measurements will be taken by our team prior to making.

  • Orders & Lead Times: Poles and tracks are ordered from external suppliers. Lead times vary. We cannot be held responsible for supplier delays.

  • Product Selection & Suitability: Guidance is offered, but final selection remains the customer’s responsibility.

  • Supplier Errors or Faulty Goods: We will liaise with the supplier to arrange replacements, but are not liable for resulting delays.

 

9. Pole & Track Installation

  • Installations: Carried out by a trusted self-employed fitter engaged by Alex Owen Brown Interiors.

  • Quotation & Cost: A fitting quote is provided prior to appointment confirmation. Additional time due to structural issues will be added to the balance invoice. 

  • Access & Site Readiness: You must provide safe and accessible premises. Furniture removal is not the responsibility of the fitter.

  • Existing Toles and Tracks: The customer is responsible for removal prior to the appointmnet. An additional charges or a second appointment may be required if the customer does not request removal as part of the job prior to the appointment .

  • Fitting Limitations: Customers are responsible for ensuring walls, ceilings, or other fixing surfaces are structurally sound. Any necessary preparatory work must be completed prior to installation. Minimum call-out fee applies if installation cannot proceed due to unsuitable fixing surfaces.

  • Hidden Services: Customers must inform the fitter of any hidden pipes or cables. We are not responsible for damage to undisclosed utilities nor the cost of repairs.

  • Rescheduling or Cancellation: Minimum 2 business days’ notice required; otherwise, the minimum call-out fee of £140 + VAT applies.

  • Liability: Alex Owen Brown Interiors is not responsible for any damages caused by the fitter during installation.

 

10. Liability

Liability of Alex Owen Brown Interiors: Whether in contract, tort, or otherwise, is limited to the total value of the order as stated on the invoice. We are not liable for indirect or consequential losses, including loss of use, damage to property, or aesthetic dissatisfaction.

 

11. Photography & Marketing

Photography: We may take photographs of completed projects at the workshop or inside the home once installed for promotional and portfolio purposes. By accepting these Terms and Conditions, you grant Alex Owen Brown Interiors a non-exclusive, royalty-free license to use images of your project in production and in situ. Customer details will never be shared without consent.

 

12. Data Protection

Personal data collected in relation to your order will be processed in accordance with the UK Data Protection Act 2018 and GDPR. Data will only be used for fulfilling your order and providing customer service.
